May young artists group discriminate against 60-year-old?
May a federally funded nonprofit that promotes the careers of classically trained musicians under the age of 26 discriminate against a 60-year-old? Violinist Martin Stoner sought to participate in the Young Concert Artists’ International Auditions to select young musicians to become members of the organization’s roster. He wrote several letters to the organization asking it to change its age eligibility requirement, and threatened litigation if he were not allowed to participate.
