Donor can’t recover gift after CEO was fired
A donor who claimed that her gifts to two nonprofit organizations were conditioned upon the organizations’ keeping their executive director for at least a year has been denied any recovery of her gifts, even though the executive director was fired in less than a year. An appellate court in Missouri has affirmed a trial court dismissal for lack of standing. Nathalie Pettus made two gifts of $20,000 each to NARAL Pro-Choice Missouri and NARAL Pro-Choice Missouri Foundation in January, 2015, which she said were made “subject to a condition subsequent” that their executive director remain in office throughout 2015.
