A Black librarian in Alabama has been denied reinstatement to her position as interim library director as the Eleventh Circuit Court of Appeals has affirmed dismissal of her section 1983 suit for violation of her Constitutional rights. The Court has agreed that there was no due process violation because she was an at-will employ who had no property interest in her continued employment, that there was insufficient evidence to allow a fact finder to infer that she was terminated because of her race, and there was no viable claim for retaliation under the Equal Protection Clause.
